In British Academy of Songwriters, Composers and Authors (BASCA) and others v Secretary of State for Business, Innovation and Skills, the High Court of Justice in matter of private copy exception provides the twofold prime opportunity to shed light on the state of the art of copyright in the UK and to flesh out the idea of 'legal hysteresis’. I support the reintroduction of the private copy exception, possibly in a less narrow fashion, and I explain the reasons why I am confident that my expectations will be fulfilled.

The Barratry of the Shipmaster in Early Modern Law: The Approach of Italian and English Law Courts

Summary For a long time, the concept of barratry (at least in its maritime meaning) was one and the same on both sides of the Channel. The barratry of the shipmaster was part of the mercantile usages, and it identified the intentionally blameworthy conduct of the master. When law courts began to decide on insurance litigation they were confronted with a notion quite alien to them. Broadly speaking, the shipmaster’s barratry could well be considered a fraud of sort. But in order to decide on its occurrence in a specific case, law courts had to analyse it in legal terms, and so according to the specific legal categories of their own system. The article examines the cases of Jőrös (Case C- 397/11,) and Asbeek Brusse,(case C‑488–11), both dated 30 may 2013, as a starting point for a more general analysis of the ECJ’s approach to the legal consequences to be drawn by the national Court from finding that a contractual term is unfair. The work focuses on the question of whether the interest of the consumer — at the basis of the remedy under consideration — is compatible with the general public interest and with the duty of the National Court to declare the nullity of its own motion, perhaps in contrast with the individual interest of the party. Il saggio esamina il sistema delle regole che ineriscono la gestione della forza lavoro nell’impresa sequestrata o confiscata per metterne in luci pregi e criticità. La ricerca mette in particolare in luce i limiti della tesi che fa leva sulla prevalenza della disciplina contenuta nell’art. 56 del d.lgs. n. 159/2011 sulle regole generali. Il tema è indagato attraverso materiale giurisprudenziale in parte inedito e una valutazione critica del ruolo del sindacato.
